Fair Use Victory Advances a Future of Accessibility for All

Two days ago, on Tuesday, June 10, the Second Circuit Court of Appeals in New York made a major ruling that emphasizes the legality of fair use for book digitization. In Authors Guild v. HathiTrust, a unanimous three-judge panel  concluded that digitizing books in order to enhance research and provide access to individuals with print disabilities is lawful on the grounds of fair use —that is, a limitation and exception to the exclusive rights granted by copyright law to the author of a creative work ( Section 107 of the U.S. copyright law). This is an immense victory for fair use as the basis of a balanced intellectual property system, and we, at Benetech, are delighted by it and by its tremendous positive implications for the public interest. Two Leaders Join Benetech’s Senior Team!

I’m thrilled to announce that Benetech has filled two key positions: Nadine Apelian Dobbs as Communications Director and Elaine Wallace as General Counsel. I think they will both make big contributions to building Benetech’s ability to deliver greater impact in the technology-for-good field. For more than a decade, Nadine has worked at the intersection of policy and media in major markets including New York, Chicago and Washington, DC. She was the Assistant Director of Communications at the Council on Foreign Relations (CFR) and then head of media for Foreign Affairs magazine in New York. When connecting with reporters, she draws heavily on her own experience working in the newsroom for leading PBS news programs. The Case for Copyright Exceptions and Fair Use

The next time you set your digital device of choice to record your favorite show so you can watch it whenever you want, take a moment to be thankful that you’re protected from lawsuits from the entertainment industry. For on January 17, 1984, the Supreme Court of the United States ruled that consumers could tape their favorite TV shows and watch them later without the copyright holder’s consent. Such action, the Court decided, didn’t constitute copyright infringement because it was fair use , that is, a limitation and exception to the exclusive rights granted by copyright law to the author of a creative work. This ruling by the Supreme Court in Sony Corp. of America v. Universal City Studios, Inc., 464 U.S. 417 (1984), also known as the “ Betamax case ”, is a landmark copyright precedent that has had enormous implications for the media economy. Address on receiving Caltech’s Distinguished Alumni Award May 18, 2013 Caltech was founded to give back to society through science and engineering, to discover knowledge and apply that knowledge. There was tremendous optimism about the value of training engineers and scientists and how that would benefit all of humanity, especially in the southern California of a century ago which was reshaped through the wonders of technology. Caltech’s small size makes its faculty and students incredibly agile when it comes to understanding a broad array of fields: there is a need here to be able to explain your work, and to understand the work of others. That’s the Caltech advantage! Richard Feynman once tried to reduce an advanced physics concept to a freshman lecture. Russia rights groups get help from Microsoft

Patrick Ball and I have often discussed the risks to social justice groups from using unlicensed proprietary software. A government could suppress a group using "piracy" as a reason, rather than criticism of the government. We've seen this happen in places like Russia. That's why it's heartening to read an article like this in the Christian Science Monitor, Russia rights groups get help from unlikely champion: Microsoft . It doesn't help Microsoft to be associated with suppression of environmental and human rights groups, and it's great to see them do the right thing!

My Davos remarks on IP

I had multiple chances to plug my ideas around a more open approach in Davos, and found a sympathetic hearing, given some exciting activity in the same area. Nike launched the GreenXchange , and the Young Global Leaders had a humanitarian patent licensing concept that seemed promising. My main talk was at a session on commercialization of university research. Here's what I said. The underlying goal of spinning off university research is seeing that society actually benefits as much as possible from the immense investment we make in research. Commercialization is a proxy for societal impact: if it sells, it's a pretty good indicator of social value. However, there is a problem with this: market failure. What if an innovation could be of great benefit to society, but doesn't make enough money? My favorite example is in the pharma area. Imagine two drugs. One would save 100,000 lives a year, but they are almost all poor people in the developing world. The other drug hel...

What would you propose to global leaders to make humanity better off? The Global Redesign Initiative is one of the core themes of next week's annual meeting of the World Economic Forum in Davos, Switzerland. I made a suggestion and got invited to Davos to discuss it. That's not an endorsement of my proposal by the WEF, but I am certainly looking forward to going next week! My proposal is that the world's knowledge should work for all of humanity. Some folks call newly developed knowledge "intellectual property," but this obscures the fact that we don't treat ideas and content the same way as we treat a house or land.
